Important views

Are you considering suing a financial institution? Or perhaps your dispute with a financial institution is already being settled by a court? An important view is an auxiliary opinion issued by the Financial Ombudsman. Although it is not binding for the court, in the justification of the decision the court should respond to the arguments presented in it.

What do you need to do to receive the so-called important view of the Financial Ombudsman?

Bring a claim to court – in formulating your claims, you may find the following useful:

  • arguments presented by the Ombudsman at the stage of intervention proceedings,
  • an opinion issued by the Ombudsman, following a conciliatory proceeding ended with a lack of an agreement

After the first exchange of pleadings, prepare an application for an important view. The application must be signed by hand. Be sure to attach to it:

  • a copy of the procedural documentation, i.e. a statement of claim, response to a statement of claim, pleadings, etc.,
  • previous correspondence with the financial market entity and the contract, regulations, GTC, attachments, annexes etc. (if the Ombudsman has not dealt with the case before)

Please note! If the application is submitted on your behalf by a representative, please attach the relevant power of attorney.

(the e-mail must contain a handwritten signature on the application or an electronic signature; the attachment must not exceed 20 MB)

Please note!

The application must include the date for the hearing, if it has been determined.

What if you do not know the hearing date at the time of submitting the application? After obtaining this information, provide it to us, preferably by e-mail to the following address: biuro@rf.gov.pl.

In the title of the e-mail, write “Important view – date of the hearing” and in the content all data allowing for identification (name, surname, address).

REMEMBER!

The important view is delivered directly to the court. The person submitting the application receives a copy of it and does not have to submit this document to the court on his/her own.
